Terms and Conditions – MML Personal Training/Online Coaching
1. Services
MML provides personal training and related coaching services within the scope of our qualifications, experience and agreed service. The precise service, number of sessions, package duration and price will be confirmed at booking or purchase.
2. Booking & payment
Sessions must be booked through the agreed booking method. Payment is due in advance of the commencement of the training period and/or session. Prices are those displayed or quoted at the time of purchase. Where a package is purchased, its included services and expiry period will be confirmed at purchase.
3. Cancellation & rearrangement
Please provide at least 24 hours notice to cancel or rearrange a session. Where adequate notice is not given, the session may be treated as used and may be charged, except where applicable law requires otherwise or we agree an exception. We will act reasonably in genuine emergencies.
4. Late arrival
Sessions will normally finish at the scheduled end time even where the client arrives late, so that subsequent appointments are not delayed. The full session fee may remain payable.
5. Trainer cancellation
If we need to cancel or rearrange a session, we will give as much notice as reasonably possible and offer an alternative appointment or appropriate refund/credit where applicable.
6. Packages/coaching
Any package or coaching programme has the duration and expiry stated at purchase. Unused sessions do not automatically roll forward unless agreed. For example; any unused PT sessions bought as part of a Hybrid-Coaching package with a set duration (12-weeks, 16-week etc) cannot be rolled over to the next 12, or 16 week training block, unless otherwise agreed.
7. Refunds & consumer rights
Nothing in these terms removes or limits any rights you have under UK consumer law. Where the law gives you a cancellation, refund, or other remedy, those rights continue to apply.
8. Health screening & disclosure
Before training, you must complete the appropriate PAR-Q, Medical Questionnaire and Informed Consent documents requested for your programme. You must provide accurate information and tell us promptly about relevant changes in health, medication, injury, symptoms or circumstances. We may pause, modify or decline a session where continuing would not be appropriate within our competence, or a client’s health and safety are at risk.
9. Medical advice & scope of practice
MML is not a medical practitioner and do not diagnose, prescribe or treat medical conditions unless separately qualified and expressly acting within that qualification. Where appropriate, we may recommend that you seek advice or clearance from a GP or other healthcare professional.
10. Exercise risk & reasonable care
Exercise carries inherent risks, including muscular soreness, strains, sprains, falls, aggravation of existing conditions and, rarely, serious injury or medical events. We will take reasonable care in screening, planning, instruction and supervision. Nothing in these terms excludes or restricts liability that cannot lawfully be excluded or restricted.
11. Client responsibilities during sessions
You agree to follow reasonable safety instructions, use equipment as instructed, disclose relevant symptoms and stop or report exercise that causes concerning symptoms or significant pain. You must not attend while intoxicated or otherwise unable to participate safely.
12. Facilities & equipment
Where training takes place at a third-party facility, you must comply with that facility's reasonable rules. We are not responsible for matters outside our reasonable control, including facility closures, equipment failures caused by others or access restrictions, except where the law provides otherwise.
13. Online coaching / home programmes
Where a programme is provided for you to complete without direct supervision, you must follow the programme only within your assessed capability and the instructions provided. You should stop and seek appropriate advice if you develop concerning symptoms, significant pain or a material change in health.
14. Photography, video & testimonials
We will not use identifiable client photographs, videos or testimonials for marketing unless you have provided the relevant separate consent. Refusing marketing use will not affect your ability to receive training.
15. Privacy & personal information
We process personal information, including health information where relevant to safe exercise, in accordance with our Privacy Notice and applicable UK data protection law. Health information is treated as special-category personal data and receives additional protection.
16. Communications
We may contact you about appointments, payments, programme administration and your service. Marketing communications will be handled in accordance with applicable electronic marketing and data protection rules, with consent or another lawful route where permitted.
17. Ending the agreement
Either party may end an ongoing arrangement subject to any valid package or notice terms and applicable consumer rights. We may suspend or end services where there is a serious safety concern, abusive behaviour, non-payment or another legitimate reason, while respecting legal rights.
18. Governing law
These terms are governed by the law of England and Wales and are subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law provides otherwise.
19. Changes to these terms
We may update these terms where reasonably necessary, for example to reflect changes in services or law. We will not use a change to retrospectively remove rights you have already acquired under a contract.
